Summary

Trial court erroneously exercised its discretion by stating that a spouse has a legal right to maintenance. Also, the court disregarded its findings as to the statutory factors. The court appeared to award maintenance in spite of its findings as to the factors rather than in accordance with them. However, the court of appeals erred by independently determining maintenance. Rather, case is remanded back to the circuit court.
