Summary

Wis. Stat. §767.24(4)(a)2 does not require a court to grant each parent equal placement if the court determines that the placement should be modified.  A circuit court is required to take into account all 16 factors enumerated in Wis. Stat. §767.24(5) as applied to the particular facts and circumstances of the child.  The maximizing language of the modification statute was not intended to create a presumption of equal physical placement when the original placement order granted one party greater placement.
